Supes set Jan. 12 hearing on Barneys appeal impacting Central Subway 

The Board of Supervisors has scheduled a 4 p.m. hearing Jan. 12 to decide whether The City has the right to take over sub-sidewalk space at 77 O’Farrell St. to make way for the Central Subway.

The City had sent a notice to revoke from 77 O’Farrell St. a city permit allowing for the use of the sub-sidewalk space, but Barneys, who occupies the space, and property owner Stockton Street Properties, Inc., are appealing the revocation. They argue that the permit is invalid because it wasn’t signed by the property owner or an authorized agent, and that the space is owned by the property owner anyway.

These arguments are expected to be sorted out on Jan. 12, barring any postponements.

The biggest worry is if the battle over the sub-sidewalk space would postpone Central Subway work
