Sixth Circuit to hear Obamacare challenge tomorrow

Challengers to the national health care law will get another whack at the bat on Wednesday, when the Sixth Circuit of Appeals considers the case filed by the Thomas More Law Center.

The makeup of the panel hearing the oral argument in Cincinatti is, on the surface, more favorable for opponents of the law, as it includes two Republican appointees and a Democratic appointee, which is a big difference from the Fourth Circuit panel that heard the Virginia-based suit last month, which was comprised entirely of Democratic-appointed judges (two of whom were appointed by President Obama himself).

Next week, the 11th Circuit will hear the higher profile case, filed by 26 states led by Florida, and that panel is made up of two Democrats and one Republican-appointed judge.
