San Jose men sentenced for beating child molester 

Two San Jose brothers have been sentenced to prison for beating a house guest after they learned he had molested their 8-year-old relative.

The San Jose Mercury News reports ( ) that Miguel Cerda received a three-year sentence and his brother Erik received a two-year sentence for the attack on Avelino Rodriguez, who is serving 22 years for sexually assaulting the girl.

Prosecutors originally had charged the Cerdas with assault, torture and mayhem, but agreed to drop the latter two charges when the brothers pleaded no contest to assault in October.

Investigators say the November 2010 beating happened after the girl told her mother Rodriguez had put duct tape over her mouth and sexually abused her.

The brothers then drove Rodriguez to a Gilroy ranch where he suffered two black eyes, a broken jaw, had teeth knocked out and bruises that appeared to have come from a whipping.
