Man wants case tossed due to crime lab fallout

The public defender for a man accused of methamphetamine possession will try to have his case overturned today as the first of several attempts to throw out cases in which alleged cocaine-skimming criminologist Deborah Madden testified.

Joseph Balingit, 33, was convicted and sentenced to drug diversion for a misdemeanor charge. During his trial, Madden testified as an expert about the drugs seized in the case, but attorneys weren’t informed of her criminal history.

As of Thursday, the drug testing center’s shutdown had led to about 180 cases being dismissed or discharged. Police were trained Thursday to perform preliminary tests on drugs to allow prosecutors to charge cases.
