Election Department denies Alioto-Pier’s reelection effort 

Supervisor Michela Alioto-Pier is termed out of office, says the City Attorney and the Elections Department, but she doesn’t think so.

On Thursday morning she filed paperwork with the Elections Department declaring her intent to run for re-election.

Later that day, Department of Elections Director John Arntz responded:

“As you know, the City Attorney issued a written legal opinion that under the Charter’s term limit provisions you are not eligible to hold office of District Two Supervisor for a new term beginning January 8, 2011,” the letter said. “Accordingly, the Department of Elections cannot list you as a candidate for this office on November 2, 2010 ballot or any other official election materials for that election.”

As The Examiner first reported in March 2008, Alioto-Pier has sought to overturn that opinion, which would mean that she cannot run for re-election.
