Court denies challenge to Vallejo recount results 

Gary Cloutier's challenge to the results of the Vallejo mayoral election was denied in Solano County Superior Court this afternoon.

The judicial assistant for Judge Wendy Getty said the judge denied Cloutier's request for a temporary restraining order prohibiting the certification of the results of a recount.

A recount last week determined the Cloutier lost to Osby Davis by two votes.

The Solano County Registrar of Voters office said Thursday that Davis won by three votes but another vote for Cloutier was found late Friday afternoon.

The Solano County Board of Supervisors certified the recount election results today and Davis is scheduled to be sworn-in at the Vallejo City Council meeting this evening. Cloutier has asked the court to stay the council from certifying the recount results.

At a news conference Monday, Cloutier charged the recount was tainted by "human manipulation and malicious meddling."

Cloutier said if the election results are certified, he will appeal.

Cloutier and Davis were tied on election night. After all the provisional and absentee ballots were counted during the next several days, Cloutier was ahead by five votes. Davis then asked for the recount.

During the recount, Cloutier was sworn in as mayor on Dec. 4.
