26 states, small businesses, file brief in anti-ObamaCare suit

Twenty-six states led by Florida, along with the National Federation of Independent Business, on Wednesday filed the brief in their lawsuit challenging the constitutionality of the national health care law.

In January, federal judge Roger Vinson struck down the entire law, arguing that the individual mandate was unconstitutional and the rest of the legislation couldn't stand without it.

The Obama administration has appealed the decision to the 11th Circuit Court of Appeals.

The brief submitted today by 26 states and the NFIB can be read here.

This case is not to be confused with a separate suit filed by Virginia challenging the constitutionality of ObamaCare. Briefs have already been filed in that case, and the Fourth Circuit of Appeals will hear oral arguments next Tuesday in Richmond.
