Recount in Vallejo mayoral race to start Monday 

A recount begins Monday to determine whether Councilman and Vice Mayor Gary Cloutier or former Solano County Supervisor Osby Davis is Vallejo’s next mayor.

The vote ended in a tie on Election Day, but after several hundred provisional ballots were counted, Cloutier won the race by five votes. Davis formally requested a recount Thursday, Assistant Solano County Registrar of Voters Lindsey McWilliams said this morning.

Three groups of four people will begin recounting 20,000 ballots by hand Monday and it should take about three days to determine the winner, McWilliams said. Cloutier, meanwhile, is to be sworn in at Tuesday’s City Council meeting.

"There are no provisions preventing Mr. Cloutier from being sworn-in," McWilliams said.

Vallejo City Attorney Fred Soley said he will recommend that Cloutier be sworn in Tuesday and if Davis wins after the recount and that result is certified by the Registrar of Voters, then the City Council can swear in Davis on Dec. 11 or at a special meeting.

Soley said the issue isn’t critical because the mayor really has no power under Vallejo’s City Manager form of government and is another member of the City Council who acts as the presiding officer.

Soley also said the City Council could just wait until Dec. 11 to swear in the mayor, whoever that may be, but he will recommend the City Council follow existing election laws.

McWilliams said Davis will pay for the recount but his money will be refunded if he wins. Solano County will then pick up the tab.

The cost of the first day of the recount is estimated at $4,368, McWilliams said, and the actual daily cost will be determined after the first day and applied to the rest of the time it takes to finish counting.

The votes of all four mayoral candidates are being recounted, McWilliams said.
