Well here’s something we didn’t see coming: The lawyers for Paula Deen and her brother Bubba are reportedly hoping to invoke the recent U.S. Supreme Court decision on Proposition 8, California’s same-sex marriage ban, to get the lawsuit against their clients thrown out.
Lisa Jackson’s case against the siblings should be dismissed because she is white and is suing on behalf of her black co-workers, E! reports. In his opinion, Chief Justice John Roberts basically said allowing people to sue on behalf of others would open a Pandora’s box of litigation.
Jackson would need to show that she has “suffered a concrete and particularized injury that is fairly traceable to the challenged conduct.” In other words, having to deal with hearing the N-word when you are not black doesn’t count. Being forced to watch your boss’s computer porn, however, which is another thing she alleges, might just count.
