In court this week: Trial court to be chosen for suspect in ’11 firefighter attack 

A court might be selected Friday to house the long-awaited jury trial of a South San Francisco man accused of running over a Cal Fire firefighter with a rental car in the Inner Richmond district, according to prosecutors.

Eduardo Chaparro Esquivel is facing multiple counts in connection with the attack that followed a brawl at the Jack in the Box on Geary Boulevard on Thanksgiving Day 2011. State firefighter and Iraq War veteran Albert Bartal went into a coma after the incident but has since awakened and is slowly recovering, according to his family.

The confrontation reportedly began in the Jack in the Box at 11th Avenue when Bartal reportedly attacked Esquivel, police say. At the time, according to Esquivel’s attorney, Marla Zamora, Esquivel had been acting as peacekeeper when he stepped between Bartal, Bartal’s friend and another group.

Surveillance video shows the confrontation in which Bartal lunges at Esquivel. While Esquivel didn’t strike back, prosecutors said he could be heard saying, “I’m gonna f*** him up! I’m fitting to go run him over!”

Esquivel then allegedly used his rental car to strike Bartal at a nearby Shell station.

CHILD PORN SUSPECT RETURNS TO COURT

A Department of Homeland Security agent charged with child pornography possession is expected back in court Friday for a preliminary hearing, prosecutors said.

Gilbert Lam was reportedly arrested at his San Francisco home in March after a San Jose police task force raided the home in 2011. Eighty videos of child pornography were found during the raid, prosecutors said, prompting a lengthy investigation.

Assistant District Attorney Alex Bastian has said that Lam placed the child pornography on a file-sharing program and made it available for download online.

One of the people who downloaded the material from his computer was an undercover officer, Bastian said.
